Terms and Conditions

1. Contest Description
NO PURCHASE NECESSARY TO ENTER OR WIN. JBoss, a division of Red Hat. ("Sponsor") is sponsoring the JBoss Innovation Award 2008 ("Contest"), a skill contest in which participants describe a business problem or project that required an innovative solution to a complex problem using JBoss and Red Hat family of products. To enter, eligible persons must go online to http://www.jbossworld.com/jbia and complete all required fields. The Contest begins on October 4,2007 at 12:01 Eastern Time ("ET") and ends on November 30, 2007 at 11:59 p.m. ET (the "Contest Term"). VOID WHERE PROHIBITED.
IMPORTANT NOTICE TO ENTRANTS: ENTRANTS ARE RESPONSIBLE FOR DETERMINING THE CORRESPONDING TIME ZONE IN THEIR RESPECTIVE JURISDICTIONS.

2. Eligibility

To be eligible to enter the Contest, you must be a (1) Red Hat partner, customer or a member of the open source community using Red Hat family of products; (2) a legal resident of Argentina, Australia, Austria, Belgium, Brazil, Canada (excluding the Province of Quebec), China, Czech Republic, France, Germany, Hong Kong, India, Ireland, Japan, Malaysia, Mexico, Netherlands, Singapore, South Korea, Switzerland, United Kingdom, and the United States (including the District of Columbia; and (3) above the age of majority in your country, province, and/or state of legal residence at the time of entry. You must also have access to the Internet and a valid email address, at the date of entry, to enter the Contest. Employees, officers, and directors of Sponsor, its subsidiaries and affiliated companies, and their immediate families and those living in their households are not eligible to enter.

If you are acting within the scope of your employment, as an employee, contractor, or agent of another party, you warrant that such party has full knowledge of your actions and has consented thereto, including your potential receipt of a prize. You further warrant that you and your employer have no claim to or right of ownership in any work product created as part of the Contest and that your actions do not violate your employer’s or company’s policies and procedures. If you are under an agreement with your employer that grants your employer ownership rights in the materials you submit to Sponsor, you are not eligible to enter. Government employees are not eligible to enter.

3.How to Enter

To enter the Contest, you must complete all required fields on the online entry form located at http://www.jbossworld.com/jbia/. A complete entry must include the following:

(1) Your name, address, phone number, email address, name of your employer, and your job title and you must select from one of the following categories contained in the entry form: (i) Joint Red Hat/JBoss Deployment; (ii) Service-Oriented Architecture Implementation; (iii) Increased Return on Investment; (iv) Ecosystem; (v) Emerging and Leading Edge Technologies; (vi) Migration; (vii) Business Process Automation; or (viii) User Experience ("Entry").

(2) A detailed description of how you implemented an innovative solution utilizing JBoss and the Red Hat family of products; and

(3) Answers to all the following questions:

  • (i) Describe your company. (Number of employees, private/public, industry, etc.)
  • (ii) Describe the business and/or technical challenges you faced in this project;
  • (iii) What was the desired solution?;
  • (iv) Describe your vendor selection process and why you choose JBoss in the end;
  • (v) Describe the application you built using JBoss. What role did Red Hat and/or JBoss products play in the final solution?;
  • (vi) What value did you gain from implementing Red Hat solutions? How did this impact your business? (e.g. improved ROI, increased competitive advantage, better time to market, etc.);
  • (vii) Please provide a technical description of implementation, including the size of deployment;
  • (viii) Did you leverage JBoss support services, training, or consulting? If so, please describe your experience?;
  • (ix) Do you have advice for other companies facing a similar business challenge?

Each of your answers to the above questions should be typed into the appropriate text boxes on the online entry form and may include a maximum of 2000 characters per answer. For your Entry to be considered eligible, you must complete and submit your Entry during the Contest Term.

4. Privacy
Entrants will be providing personal information when they complete and submit the Entry form and information will be transferred to servers located in the U.S. and the information may be transferred to third parties. By registering for the Contest, you consent to the Sponsor’s privacy policy.

5. Sponsor
Red Hat, Inc., located at 1801 Varsity Drive, Raleigh, North Carolina, 27606, USA, is the Sponsor of the Contest.

6. Submission of Entries
All Entries must be submitted in English. Entries that are in any other language will not be considered.LIMIT ONE (1) ENTRY PER INDIVIDUAL. Subsequent Entries will be disqualified. All Entries become the property of Sponsor. They will not be returned or acknowledged. Entries are void if they are in whole or part illegible, incomplete, damaged, altered, counterfeit, manipulated or obtained through fraud or lost, late, misdirected, mutilated, incomplete, or illegible entries or email, or for any computer related, online, telephonic, or technical malfunctions that may occur whether or not within Sponsor’s control.

7. Judging
The judging will occur in two rounds. In the first round, eight (8) finalists will be selected, one from each of the eight (8) entry categories listed on the online entry form (the "Finalists"). In the final round, one (1) Grand Prize winner will be selected from the eight Finalists (the "Grand Prize Winner").

First Round

The first round of judging will take place beginning on December 1, 2007 and ending on December 15, 2007 ("First Round"). In the First Round, all Entries will be judged by a panel of experts in the field of business and open source technology ("Judges") based on the following criteria:

First Round. The first round of judging will take place beginning on December 1, 2007 and ending around December 15, 2007 ("First Round"). In the First Round, each Entry will be evaluated by the judges based on the following criteria:

Creativity or innovative ways utilizing Red Hat technology? 20%
Extent existing processes were improved or new processes were successfully implemented by the project 15%
Extent to which the solution overcame technology challenges to achieve goal 20%
Extent of any identifiable improvements to the business 20%
Extent of any measurable Return on Investment and increase in competitive advantage generated by the project 15%
Was the entry articulate and concise? 10%

The entry that received the highest score from the Judges in each category will be selected to advance to the final round of judging ("Finalist"). The Judges will select one (1) potential Finalist from each of the eight (8) categories listed in the online entry form. In the event of a tie, the Entry that received the highest score from the Judges in the category of "Identifiable Improvements to the Business" will advance to the final round of judging as a potential Finalist. The potential Finalists will be notified by e-mail that they were selected as a potential Finalist in the Contest on or about December 15, 2007. If the e-mail notification is returned as undeliverable, the potential Finalist will be disqualified and an alternate potential Finalist will be selected based on the criteria for the selection of the Finalists described herein. The potential Finalists may be asked to sign a Declaration of Eligibility, IP Assignment, Release of Liability and/or Publicity Release (the "Declaration"), where lawful. Only if the Declaration is fully executed and returned within seven (7) days of attempted notification by Sponsor may the potential Finalist move into the Final Round of judging. If Sponsor does not receive the Declaration within seven (7) days of attempted notification, Sponsor may, in its sole discretion, select another potential Finalist from the remaining eligible Entries based on the selection criteria described herein.

Final Round. The final round of judging will take place beginning on January 14, 2008 and ending on February 14, 2008 ("Final Round"). In the Final Round of judging, the Finalist Entries will be posted on the Contest website located online ("Contest Website"). The Grand Prize Winner ("Innovator of the Year") will be selected based on voting by the open source community ("Voters") and evaluation by the Judges. Beginning January 14, 2008 at 12:01 Eastern Time and until February 14, 2008 at 12:01 Eastern Time (the "Voting Period"), Voters may cast one (1) vote on the Contest Website for the best Finalist Entry based on the following criteria:

Whether the Entry is articulate and concise10%

Each Voter may submit only one (1) vote online. Any subsequent votes submitted by a Voter will be disqualified. Once the Voting Period has ended and the results have been tallied, each Entry will be evaluated by the Judges based on the following criteria:

Extent of any identifiable improvements to the business 10%
Extent of any measurable Return on Investment and increase in competitive advantage generated by the project 10%
Whether the Entry was articulate and concise 20%
How many votes the Entry received from Voters 40%

The Entry that receives the highest overall score from the Judges will be selected as the potential Grand Prize Winner. In the case of a tie, the Entry that receives the highest score from the Judges in the category of "How many voters the Entry received from Voters" will be selected as the potential Grand Prize Winner. The winner will be selected and notified on February 15, 2008 and announced at an awards ceremony at the 2008 JBoss World Convention in Orlando, Florida on February 15, 2008 . The Judges’ decisions are final with respect to all aspects of the Contest. Winner does not have to be present to win. If, in Sponsors’ opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if technical difficulties compromise the integrity of the Contest, the Sponsor reserves the right to terminate the Contest. Any attempt to deliberately damage the content or operation of this Contest is unlawful and subject to legal action by Sponsor or its agents.

8. Ownership of Entry of Finalist

Finalists agree to exclusively and irrevocably assign, convey and transfer to Sponsor any and all right, title and interest in their Entry, including the copyright, right of publicity, moral rights and any ideas included in the Entry and understand that the Finalist may be required to sign a document to this effect.

Finalists understand that this assignment shall give Sponsor sole ownership over their Entry and that Sponsor, therefore, shall have the right to transfer or assign any part or all of the Entry, without limitation. Sponsor also shall have the right to edit, adapt and publish any or all of the Entry, and may use it in any media including, without limitation any new technologies that are yet to be developed, without attribution or compensation to the Finalist, his/her successors or assigns, or any other entity. Further, this assignment shall give Sponsor the right to use the Finalists’ Entry in perpetuity and throughout the universe without further consideration. If a Finalist does not want to assign such rights to Sponsor, (s)he may not be able to receive the prize.

9. Prizes

Grand Prize: One (1) Grand Prize Winner will receive: (i) $1,000 USD; (ii) free admission for three (3) people to either the Red Hat Summit 2008 or future JBoss World Convention, including access to all JBoss World Convention or Red Hat Summit sessions, conference meals, and special events; Approximate Retail Value ("ARV") of the Grand Prize is $4,500 USD.

Finalist Prizes: The seven (7) Finalists who are not selected to be the Grand Prize Winner will each receive: (i) free admission for one (1) person to the 2008 JBoss World Convention in Orlando, Florida, including access to all JBoss World Convention sessions, conference meals, and special events; (ii) double-occupancy hotel accommodation for two (2) nights in Orlando, Florida; (ii) an invitation to attend the VIP Executive dinner during the Conference with Red Hat and JBoss executives, Summit keynote speakers, and other honored guests; (iii) an Innovation Award presentation with a profile of your company at the JBoss World Convention general session; and (iv) the opportunity to highlight your accomplishments and receive recognition by your peers for being an innovator and a leader in your field (“Finalist Prize”). The ARV of each Finalist Prize is $1695 USD. If a Finalist Winner has already paid for their JBoss World registration, Red Hat will reimburse your registration fees up to $1695 USD.

The ARV of all Prizes is $16,365 USD. The winners are responsible for any other expenses including cost to travel to and from the JBoss World Convention or Red Hat Summit, and any other expenses incidental travel cost not expressly stated above, including but not limited to, ground transportation, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of the winner. Prizes are not redeemable for cash. No prize substitution, cash substitution, or assignment or transfer of any of the prizes is permitted, except by Sponsor, in which case a prize of equal or greater value will be awarded. The prizes consist of only those items specifically listed as part of the prize. Prizes are awarded without warranty of any kind from Sponsor, express or implied, without limitation, except where this would be contrary to federal, state, provincial, or local laws or regulations. All taxes, costs, and fees associated with the prizes are the sole responsibility of the winners. LIMIT ONE PRIZE PER PERSON. Odds of winning depend on the number of eligible Entries received and the skill of the entrants.

10. Condition of Participation

By entering the Contest, you agree to be bound by the terms of these Official Rules and you confirm that you meet all eligibility requirements listed herein. You agree that all federal, state, provincial and local laws and regulations apply. By registering for the Contest, you agree that these Official Rules and the decisions of Sponsor are final and binding on all matters pertaining to this Contest. By registering for the Contest, you warrant and represent that you are the sole author and creator of the Entry, that your Entry does not violate any applicable law, and that you have no reason to believe that your Entry infringes or violate any intellectual property right held by any third person. All Entries will be deemed made by the authorized account holder of the email address submitted at the time of entry, and any potential winner may be required to show proof of being the authorized account holder for that email address. The "authorized account holder" is the natural person assigned to an email address by an Internet service provider, online service provider, or other organization responsible for assigning email address for the domain.

Acceptance of the priz constitutes permission for, and winners consent to, Sponsor and its agencies to use the winning Entries and the names and/or likenesses of the winners for advertising and promotional purposes, in any media now known or hereafter devised, without further notice, compensation, consideration, review, or consent, and without regard to moral rights, unless prohibited by law. To the extent permitted by law, all registered participants of the Contest agree to hold Sponsor, its respective directors, officers, employees and assigns harmless for any injury or damage caused or claimed to be caused by participation in the Contest and/or use or acceptance of any prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest, or in the announcement of the prize. If, in Sponsors’ opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if technical difficulties compromise the integrity of the Contest, the Sponsor reserves the right in its sole discretion, to cancel, terminate, modify or suspend the Contest. Any attempt to deliberately damage the content or operation of this Contest is unlawful and subject to legal action by Sponsor or its agents. You may be prohibited from participating in this Contest if Sponsor, in its sole discretion, reasonably believes that you have attempted to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices, or annoys, abuses, threatens, or harasses any other participants, Sponsor, or associated agencies. In the event a potential winner’s employer has a policy that prohibits the awarding of a prize to an employee, the prize will be forfeited and an alternate winner will be selected.

11. Governing Law

This Contest and Official Rules are governed and interpreted by the laws of the State of North Carolina in the United States without regard to its conflict of law provisions.

12. Official Rules / Winners List

Sponsor will post the Official Rules and Winners List online at www.jbossworld.com, and will maintain the Winners List for approximately 2 years after the selection of the winner.
